We enforce the law with respect to a number of products which, because of their nature, cannot be sold to young people.
If you have concerns that a retailer is selling goods in breach of the age restriction this information can be passed to Consumer Direct on 08454 040506 or Crimestoppers on 0800 555111.
If you are a business requiring advice on the law and what precautions you should be taking to ensure you and your staff comply with the law please contact one of our offices. An officer can discuss legal requirements and best practice with you and provide an information pack.
List of Age Restricted Products enforced by Consumer Protection:
| Products | Age Restriction |
|---|---|
| DVDs / Videos / Computer Games etc | As marked |
| Cigarettes & Tobacco | 18 |
| Fireworks | 18 |
| Lighter refills | 18 |
| Aerosol Paints | 16 |
Statutory Notices
Retailers supplying tobacco products, fireworks and aerosol paints are required to display a legal notice declaring it is illegal to supply that product to those under the specified age limit.
The Tobacco Notice (& further information) can be found at www.tobaccoagechange.co.uk
Enforcement
Sales of products to young people is a serious offence and, depending on the product, both the business and member of staff making the sale can be prosecuted. A prosecution may result in a significant fine of up to £5000 as well as a criminal record.
Identification
If there is any doubt whatsoever over a young persons age then photographic ID should be asked for. It is however possible to purchase fake ID and as such Aberdeenshire Consumer Protection supports the PASS “Proof of Age Standard Scheme”. ID cards approved by the scheme will have a holographic logo on to assure the retailer it is genuine. An information pack can be provided by contacting Consumer Protection and further details can be found at www.pass-scheme.org.uk.
